Teoria dreptului natural (Partea I)

Abstract

Filosofia dreptului examinează ceea ce trebuie sau ceea ce ar trebui sa fie în drept, în opozitie cu ceea ce este. Ea descrie originea şi evolutia dreptului, verifică şi pregateste recunoasterea pozitivă a idealului juridic. În lucrare este prezentată concepţia jusnaturalistă (de la “jus naturale” – drept natural) promovată de marii filozofi din antichitate până în prezent.

Philosophy of Law examines what should or what should be the law, as opposed to what is. It describes the origin and evolution of law, checks and prepares legal ideal of positive recognition. The paper presents the jusnaturalist conception (from "natural jus" - natural law) promoted by great philosophers from antiquity to the present.

Philosophie du droit examine ce qui doit ou ce que devrait être la loi, par opposition à ce qui est. Il décrit l'origine et l'évolution du droit, vérifie et prépare juridique idéal de reconnaissance positive. L'article présente la conception jusnaturalist (de "jus naturel" - la loi naturelle) promu par les grands philosophes de l'Antiquité à nos jours.

Философия права исследует то, что должно или каким должно быть право, а не то, что есть. Она описывает происхождение и эволюция права, проверяет и готовит положительное признание юридического идеала. В статье представлена жуснатуралисткая концепция (от "natural jus" - естественный закон) выдвигаемая великими философами от античности до наших дней.
