Servituţile personal

Abstract

Prezenta lucrare are ca scop cercetarea fenomenului juridic denumit servituţile personale, elucidarea reglementărilor referitoare la servituţile personale din Republica Moldova şi din alte state care cunosc această instituţie juridică, precum şi analiza opiniilor din lucrările şi comentariile ştiinţifice efectuate în domeniu. Iar, în baza acestor cercetări, evidenţierea trăsăturilor esenţiale ale servituţilor personale, ne va permite să-l delimităm de alte drepturi reale asemănătoare precum şi evidenţierea particularităţilor modalităţilor de constituire, exercitare şi stingere a acestuia se formează propuneri proprii în perfectarea și ilucidarea legislaţiei cu privire a servituților personale.

The present work has as a main target the research of juridical phenomena named personal servitudes, elucidation of regulations referring to personal Servitudes from the Republic of Moldova and from the other countries that know this juridical institution, as well as the analysis of opinions from scientific works and comments made in the field. But, on the basis of these researches, highlighting of the essential features of personal servitudes will permit us to delineate it from other real similar rights as well as highlighting the particularities of the modalities of constitution, exercising and its extinction; there are created own proposals in performing and elucidation of legislation about personal servitudes.
