Despre cadrul juridic privind proprietatea publică şi descentralizarea patrimonială în Republica Moldova

Abstract

Diversity and multiplicy of laws governings property law, lack of clearly determined criteria, which ensure demarcation of state properties of municipalities property, the public property of the state or municipalities of their assets in private, absence of imperative legal regulations that ensure de jure and de facto demarcation of public property and patrimonial decentralization in Moldova. The ownership of municipalities is a legal right and a basic structural element of local autonomy and this right of municipalities has to be defended and equally protected by law same as the right to private property of individuals and / or private legal persons.
