Succesiunea testamentară în noul Drept Succesoral

Abstract

Scopul prezentului studiu constă în efectuarea unei investigaţii complexe și științifice a instituţiei succesiunii testamentare, prin prisma analizei regulilor de drept ce guvernează această materie, valorificând în acest sens cadrul legal şi abordările doctrinare în domeniu, precum şi în formularea unor soluţii şi propuneri vizând perfecţionarea legislaţiei ce reglementează succesiunea testamentară. Principalele obiective ale lucrării sunt: analiza opiniilor, ideilor, concepțiilor expuse în doctrina teoriei generale a dreptului atât din Republica Moldova, cât și din literatura juridică din alte state, care au ca obiect succesiunea testamentară, testamentul; determinarea principalelor evenimente istorice care au determinat evoluția instituției succesiunii testamentare; a analiza noţiunea și caracterele juridice ale transmisiunii testamentare; a elucida condițiile de valabilitate și data deschiderii moștenirii testamentare; a indentificarea specificul testamentelor ordinare și testamentelor privilegiate conform noi reglementării a Codului. Civil; a analiz conţinutul şi efectul testamentului mistic la etapa actuală; indentificarea modalității de modificarea, revocarea, nulitatea și caducitatea testamentului.

The purpose of this study is to conduct a complex and scientific investigation of the institution of testamentary succession, through the analysis of the rules of law governing this matter, capitalizing on the legal framework and doctrinal approaches in the field, as well as formulating solutions and proposals to improve legislation. which regulates the testamentary succession. The main objectives of the paper are: the analysis of the opinions, ideas, conceptions set forth in the doctrine of the general theory of law both in the Republic of Moldova and in the legal literature of other states, which have as object the testamentary succession, the will; determining the main historical events that determined the evolution of the institution of the testamentary succession; to analyze the notion and the legal characters of the testamentary transmission; to elucidate the conditions of validity and the date of opening the testamentary inheritance; to identify the specifics of ordinary wills and privileged wills according to the new regulations of the Civil Code; analyzed the content and effect of the mystical will at the present stage; identification of the manner of modification, revocation, nullity and expiration of the will.
