Regimul juridic al superficiei

Abstract

Teza de master reprezintă o analiză multiaspectuală a doctrinei, legislației și a practicii judiciare din Republica Moldova și din alte țări, privind anumite relații patrimoniale, în speță dreptul real imobiliar de a poseda și folosi terenul altuia în vederea edificării și exploatării unei construcții a superficiarului, la fel descrierea principalelor aspecte și probleme existente în prezent privind publicitatea imobiliară a instituției superficiei. Lucrarea este dedicată întru rezolvarea chestiunilor ce țin de specificul reglementărilor juridice în materia instituției superficiei, deoarece modificările permanente a cadrului legislativ și lipsa unei practici uniforme privind soluționarea judiciară a litigiilor izvorâte în urma constituirii dreptului de superficie legală asupra bunurilor imobile, trezesc multe semne de întrebare, iar prezenta lucrare contribuie la clarificarea unor importante probleme din domeniul supus cercetării.

The master's thesis is a multifaceted analysis of the doctrine, legislation and judicial practice of the Republic of Moldova and other countries, regarding certain patrimonial relations, namely the real estate right to own and use another person's land in order to erect and exploit a construction of superficiary, as well as the description of the main aspects and existing problems regarding the real estate advertising of the surface institution. The paper is dedicated to resolving issues related to the specific legal regulations on the institution of the surface, because the permanent changes in the legislative framework and the lack of a uniform practice on the judicial resolution of disputes arising from the establishment of the right of legal surface on real estate, raise many questions, and this paper helps to clarify important issues in the field under research.
