Exercitarea şi apărarea drepturilor de proprietate comună în devălmășie

Abstract

Scopul şi obiectivele tezei: analiza temei abordate și cercetarea aspectelor pe care le comportă au fost realizate ținând cont de autorii literaturii din domeniu. Dreptul de proprietate are o anumită complexitate care rezultă din aceea că dreptul nu mai este pur şi simplu, ci afectat de modalități, în sensul că, fie este un drept asupra unuia sau mai multor bunuri care aparțin simultan mai multor titulari, fie existenta viitoare a dreptului în patrimoniul titularului este legată de un eveniment sau de o împrejurare prevăzută de lege ori care este stabilită prin voința omului. Obiectivele generale a tezei sunt orientate spre cercetarea complexă și sistemică a dreptului de proprietate ca fiind un drept asupra unuia sau mai multor bunuri care aparțin simultan mai multor titulari, fie existenta viitoare a dreptului în patrimoniul titularului este legată de un eveniment sau de o împrejurare prevăzută de lege ori care este stabilită prin voința omului.

The purpose of the paper: the analysis of the approached topic and the research of the aspects it entails were carried out taking into account the authors of the literature regarding the addressed field. The right to property has a certain complexity resulting from the fact that the right is no longer simple term, but affected by modalities, in the sense that, it is either a right regarding one or more goods belonging simultaneously to several holders, either the future existence of the right in the owner’s estate is linked to an event or circumstance provided by law or determined by the will of the person. General objectives: are geared toward complex and systemic research into means of evidence and probative processes are of particular importance in criminal proceedings, since together with evidence they are closely linked to the achievement of the basic rule of truth, and also because major part of the penal process is related to evidence and more evidence.
