Apărarea dreptului de proprietate

Abstract

Proprietatea este un fenomen complex, care implică o netăgăduită stare de progres şi stabilitate socială. Noţiunea de stabilitate, dacă nu dă naștere existenței însăși a dreptului de proprietate, asigură în orice caz respectul acordat acestui drept. Apărarea raporturilor juridice ale drepturilor reale constituie astăzi fundamentul oricărei orânduiri sociale, reprezentând în același timp sarcina esențială a tuturor sistemelor de drept. Astfel, dreptul de proprietate, cel mai important dintre drepturile reale, ca şi desmembrămintele sale, este apărat printr-o diversitate de mijloace juridice, reglementate de diferite ramuri ale sistemului nostru de drept.

Property is a complex phenomenon, which implies an undeniable state of progress and social stability. The notion of stability, if it does not give rise to the very existence of the property right, ensures in any case the respect given to this right. The defense of the legal relations of real rights is today the foundation of any social order, representing at the same time the essential task of all legal systems. Thus, the right to property, the most important of the real rights, as well as its dismemberments, is defended by a variety of legal means, regulated by different branches of our legal system.
