Reglementarea juridică a contractului de depozit în Republica Moldova

Abstract

Scopul lucrării: de a studia reglementarea legală, caracteristicile conținutului și încheierea unui contract de depozitare, precum și de a identifica problemele de reglementare juridică și practică de aplicare a acestui contract.

Obiectivele generale: definirea noțiunii, determinarea esenței și a caracterelor contractului de depozit; definirea depozitului sub aspect juridic; analiza comparativă a reglementărilor juridice privind contractul de depozit reglementat în legislația Republicii Moldova, în alte state, precum și a normelor unificate în materie; evidențierea și analiza lacunelor și incertitudinilor legale precum și a problemelor actuale în procesul de exercitare a operațiunilor de depozit; determinarea naturii contractului prin analiza conceptelor teoretice fundamentate privind depozitul, a caracterelor, elementelor și a conținutului acestuia; formularea concluziilor și recomandărilor finale.

Metodele аplicаte lа elаborаreа lucrării: pentru rezolvarea obiectivelor stabilite, studiul de față s-a bazat pe metoda dialectică științifică generală a cunoașterii științifice, care presupune obiectivitatea și comprehensiunea cunoașterii fenomenelor studiate. Alături de aceasta s-au folosit metode istorice, sistemico-juridice, comparativ-juridice și alte metode de cercetare științifică

Rezultatul concret obţinut: în urma elaborării cercetării ştiinţifice în domeniul reglementării juridice a contractului de depozit, а fost întitulată o lucrare unică în аceаstă tematică, cu o examinare aprofundată а tuturor elementelor esenţiale, precum şi un șir de relatări ce pot servi exemplu pentru o viitoare analiză, sau drept sursă în alte domenii, altele decât dreptul.

The purpose of the thesis: to study the legal regulation, the characteristics of the content and the conclusion of a storage contract, as well as to identify the problems of legal regulation and practical application of this contract.

General objectives: defining the notion, determining the essence and characteristics of the deposit contract; defining the deposit from a legal point of view; the comparative analysis of the legal regulations regarding the deposit contract regulated in the legislation of the Republic of Moldova, in other states, as well as the unified norms in the matter; highlighting and analyzing legal gaps and uncertainties as well as current problems in the process of exercising deposit operations; determining the nature of the contract by analyzing the grounded theoretical concepts regarding the deposit, its characters, elements and content; formulating conclusions and final recommendations.

Methods applied for the elaboration of the thesis: to solve the established objectives, the present study was based on the general scientific dialectical method of scientific knowledge, which assumes the objectivity and comprehensiveness of the knowledge of the studied phenomena. Along with this, historical, systemic-legal, comparative-legal and other scientific research methods were used

The actual result obtained: following the elaboration of the scientific research in the field of the legal regulation of the deposit contract, a unique work on this topic was titled, with an in-depth examination of all the essential elements, as well as a series of reports that can serve as an example for a future analysis, or as source in fields other than law.
