Formarea și înregistrarea dreptului de superficii, satul Olișcani, raionul Șoldănești

Abstract

Scopul proiectului: asigurarea și apărarea dreptului de proprietate și a altor drepturi reale. Acest subiect este actual datorită faptului că prin dreptul de superfcie a fost creată folosirea mai ratională și eficientă a terenurilor și construcțiilor de aceea este binevenit ca acest drept șia găsit reglementarea legală in codul civil al Republicii Moldova. Scopul lucrării constă în familiarizarea cit mai profundă în domeniul drepturilor reale și anume a dreptului de superficie pentru atingerea următoarelor obiective: descrierea rolului măsurărilor cadastrale și a înregistrării bunurilor imobile. Pentru realizarea proiectului au fost studiate sursele istorice cu privire la înregistrarea dreptului de superficii, dosare cadastrale, codul civil si actele legislative. In intermediul lucrării sunt prezentate și ilustrare metodele de înregistrare a bunurilor imobile, metodele de formare si dobîndire precum și descrierea odiectului. în elaborarea lucrării au fost utilizate softurilre de scanare și de arhivare a informației, datele păstrate pe suport de hirtie precum și dosare cadastrale. În urma acestei lucari au fost obținute urmatoarele beneficii pentru proprietarii de terenuri care se datorează masurărilor cu precizie și o exacticitate mai mare care oferă identificarea în natură a dreptului de proprietate care este singurul drept subiectiv care conferă prin intermediul sau titularului dreptul de protectie a bunului.

The purpose of the project: ensuring and defending property rights and other real rights. This subject is current due to the fact that through the surface right, a more rational and efficient use of land and constructions was created, the refore it is welcome that this right found legal regulation in the civil code of Republica of Moldova. The propose of the work is to familiarize as much as possible in the field of real rights, namely the surface right, in order to achieve the following objectives: description of the role of cadastral measurements and the registration of immovable property. For the realization of the project, the historical sources regarding the registration of the surface right, cadastral files, the civil code and legislative acts were studied. Through the work, the methods of registration of real estate, the methods of formation and acquisition, as well as the description of the object are presented and illustrated. Scanning and archiving software, data strored on paper as well as cadastral files were used in the elaboration of the work. As a result of this work, the following benefits were obtained for the land owners who it is due to the measurements with precision and agreater accurancy that offers the identification in nature of the property right which is the only subjective right that confers through its holder the right to protect the property.
