Principiile aplicării sancţiunilor juridice

Abstract

The relations governed by rules of law are not torn from one another, but they are linked by the mutual and multilateral interdependence within a complex system. Therefore, the sanctions intended to protect those relationships, should be examined also within a particular unity and internal interdependence, in the system. As any system, the system of sanctions must be built on some basic principles. In this regard, the research of the sanctions would not be complete if we didn’t research the principles for the application of the sanctions, as the special nature of their application is discovered only through them.

Relaţiile reglementate de normele de drept nu sunt rupte una de alta, ci se află în legătură reciprocă și interdependenţă multilaterală în cadrul unui sistem complex. De aceea, și sancţiunile destinate protecţiei acestor raporturi, trebuie examinate de asemenea într-o anumită unitate și interdependenţă internă, adică în sistem. Ca și oricare sistem, sistemul sancţiunilor trebuie să fie construit pe anumite principii de bază. În acest sens, cercetarea sancţiunilor, nu ar fi deplină, dacă nu am cerceta principiile de aplicare a sancţiunilor, doar anume prin ele se descoperă caracterul deosebit al aplicării lor.
