Noțiunea, conținutul și clasificarea sancțiunilor juridice

Abstract

The study of problems concerning legal penalties extends our knowledge about their importance, namely, the legal regulation, the way the legal rules influence on the behaviour of the society members, etc. To understand the law and the legal sanction, we should be aware not only of what the legal penalties represent under the conditions of the contemporary development of the state and society, which are their content, but their classification structure is also important, which is connected directly to the definition, penalty application and allows us to answer to a series of questions of practical importance: is it allowed or not to replace one type of sanctions with penalties of a different type, is it possible to combine different types of sanctions. The settlement of the issue is also important within the named problem: to use or not the whole diversity of legal sanctions in the mechanism of legal liability.

Studierea problemelor privind sancțiunile juridice extinde cunoștințele noastre despre importanța lor, și anume, despre reglementarea juridică, modul de influență a normelor juridice asupra comportamentului membrilor societății etc. Pentru înțelegerea dreptului și sancționării de drept trebuie de conștientizat nu doar ce reprezintă sancțiunile juridice în condițiile de dezvoltare contemporană a statului și societății, care este conținutul lor, dar este importantă și structurizarea clasificării lor, care este legată nemijlocit cu definirea, aplicarea sancțiunilor și permite de a da răspunsuri la o serie de întrebări de importanță practică: se admite sau nu înlocuirea sancțiunilor de un tip cu sancțiuni de alt tip, este oare posibilă combinarea sancțiunilor de diferite tipuri. De asemenea, în cadrul problemei numite este importantă soluționarea chestiunii: se utilizează sau nu toată diversitatea de sancțiuni juridice în mecanismul răspunderii juridice.
