Abstract:
This article aims to study the procedure of sharing the real estate, to define its scope and to lay down the basic principles for the application of immovable property dividing. The common property sharing procedure is highlighted as a form of technical and economic expertise. Two main approaches of sharing are presented: by the procedure of real property formation and the establishment the use mode of common property. The difficulties of different approaches applying as well the suggestions of their solving are discussed. The conclusions and proposals which would result logically from the investigations carried out in the paper are submitted. The results will contribute to the enrichment of the doctrine in the issues concerned and the improvement of the legislation in force. The content of this article can serve as a support for specialists in the field of technical and economic expertise of common immovable property and as a teaching material for students of any degree of economics and management of real estate, patrimonial law or for any other interested person.
