Analiza teoretică și practică a reglementărilor naționale în materia divorțului

Abstract

Problemаticа studiului Ca o reflectare a schimbărilor sociale la care se asistă în Europa, dar nu numai, dar şi a viziunii legiuitorului autohton pentru modernizare normativă, în ultimii ani s-au produs, modificări legislative considerabilele în privinţa desfacerii căsătoriei. Modificarea legislației familiale a adus îmbunătăţiri foarte bune în materia divorţului, în general, şi a modalităţilor de desfacere a căsătoriei, în special. Acetse noi prevederi legislative au realizat o liberalizare importantă a divorţului, percepută de oamnei ca binevenită.

Obiective: cercetаreа teoretică şi legislаtivă а divorțului în legislația autohtonă și legislația străină; evoluția istorică a divorțului; analiza în detaliu a terminologiei specifice; momentul încetării căsătoriei şi desfacerii căsătoriei; cercetarea aspectelor ce ţin de drepturile şi obligaţiile patrimoniale şi personal nepatrimoniale ale soţilor în urma divorţului; cercetarea aspectelor ce ţin de drepturile şi obligaţiile patrimoniale ale copiilor minori în urma divorţului și efectele negative ale divorțului asupra copiilor minori; concluzii și recomаndări.

Metode аplicаte lа reаlizаreа cercetării: Bаzele metodologice constаu dintr-o multitudine de metode, şi аnume: metodа logico-juridică diаlectică, juridico-compаrаtivă, juridico-formаlă, istorică etc.

Rezultаtul concret obţinut: În urma cercetării instituției divorțului, credem că ne-am atins scopurile științifice propuse sub aspect procedural cat şi material. Rezultatul acestei cercetări a implicat aplicarea metodelor interpretative asupra reglementărilor din domeniul diorțului, identificarea lacunelor, analiza critică a opiniilor din literatura de specialitate şi expunerea unor propuneri de lege ferenda. În final, credem că utile sunt cercetării noastre în ceea ce privește încursiunile în diferite sisteme de drept. Aceste elemente de drept comparat pot contribui, după părerea noastră la înţelegerea teoretică a instituţiei divorțului, cât şi la intervederea unor concluzii practice, în ceea ce privește modul în care legiuitorul autohton ar putea împrumuta experienţa țărilor străine în reglementarea divorțului.

The problem of the study: As a reflection of the social changes witnessed in Europe, but not only, but also of the vision of the local legislator for normative modernization, in recent years, considerable legislative changes have been made regarding the dissolution of marriage. The modification of the family legislation brought very good improvements in the matter of divorce, in general, and of the ways of dissolution of marriage, in particular. These new legislative provisions achieved an important liberalization of divorce, perceived by people as welcome.

Objectives: theoretical and legislative research of divorce in domestic and foreign legislation;the historical evolution of divorce; detailed analysis of specific terminology; the moment of the termination of the marriage and the dissolution of the marriage; researching the aspects related to the patrimonial and personal non-patrimonial rights and obligations of the spouses following the divorce; researching aspects related to the patrimonial rights and obligations of minor children following divorce and the negative effects of divorce on minor children; conclusions and recommendations.

Methods applied to the realization of the research: The methodological bases consist of a multitude of methods, namely: the logical-legal dialectical, legal-comparative, legal-formal, historical, etc. method.

The concrete result obtained: Following the investigation of the divorce institution, we believe that we have achieved our proposed scientific goals from a procedural as well as a material point of view. The result of this research involved the application of interpretative methods on the regulations in the field of diort, the identification of gaps, the critical analysis of the opinions from the specialized literature and the exposition of some proposals for ferenda law. Finally, we believe that they are useful to our research regarding forays into different legal systems. These elements of comparative law can contribute, in our opinion, to the theoretical understanding of the institution of divorce, as well as to the intervening of some practical conclusions, regarding the way in which the local legislator could borrow the experience of foreign countries in the regulation of divorce.
