Regimul juridic al cetățeniei Republicii Moldova

Abstract

Scopul studiului. Scopul studiului a fost orientat spe identificarea instituției cetățeniei cu o analiză doctrinară și normativă a regimului juridic ale cetățeniei Republicii Moldova.

În realizarea scopului propus au fost canalizate următoarele obiective: analiza teoriei dreptului privind instituția cetățeniei; cercetareainstituției cetățeniei în perioada modernă; examinarea tipizării doctrinare a cetățeniei în perioada contemporană; identificarea conceptului juridic al cetățeniei; analiza reglementărilor internaționale privind naționalitatea și cetățenia; examinarea legislației europene privind protecția instituției cetățeniei în legislația UE; cercetarea reglementărilor legislative naționale privind cetățenia; analiza principiilor generale ale cetăţeniei Republicii Moldova; studierea statului juridic al cetățeanului Republicii Moldova; discuții asupra modalităților de dobândire a cetățeniei; analiza studiului de caz.

Metodologia cercetării a fost întemeiată pe analiza doctrinară și legislativă a conceptului și instituției cetăţeniei. Din acest punct de vedere au fost analizate un număr de norme ce reglementează raporturile sociale grupate în jurul necesităţii de a se asigura plenitudinea drepturilor şi obligaţiilor prevăzute de constituţie şi legi acelor persoane care, prin sentimentele şi interesele lor, sunt strâns legate de destinele statului. Un alt segment al dezbaterilor contemporane asupra cetăţeniei ţine de diversitatea modelelor acesteia, tematica fiind motivată de exitenţa neîncrederii în capacitatea statului de a garanta în continuare justiţia socială, interesul comun şi ordinea civică. În linii generale concluzionăm că: Garanțiile constituționale ale dreptului la cetățenie ale individului, reprezintă un ansamblu integrat de condiții economice, sociale, politice, ideologice, consacrat de Constituția Republicii Moldova, care instituie posibilitatea de executare și mecanismele respectării acestuia. În legislaţiile naţionale în materie de cetăţenie se fundamentează pe principiile: a) dreptul fiecărei persoane la o cetăţenie; b) nedescriminarea cetăţenilor, indiferent de temeiurile dobîndirii cetăţeniei; c) inadmisibilitatea privării arbitrare a persoanei de cetăţenia ei şi de dreptul de a-şi schimba cetăţenia; d) evitarea apatridiei; e) neproducerea de efecte, prin schimbarea cetăţeniei unuia dintre soţi, asupra cetăţeniei celuilalt soţ sau asupra cetăţeniei copilului dacă nu există o cerere scrisă în acest sens a părinţilor. Legislația Republicii Moldova privind instituția cetățeniei se încadrează în cerințele internaționale privind cetățenia și este conformă cu principiile stabilite de Convenția europeană cu privire la cetățenie. Cetățenia este analizată din două perspective: ca condiţie juridică - calitatea individului care confirmă apartenenţa la un stat și condiționează calitatea de cetățean şi instituţie juridică constituită dintr-un ansamblu de norme juridice. Dreptul la cetăţenie este un drept fundamental al persoanei, care pune în valoare celelalte drepturi cetăţeneşti. Cetăţenia Republicii Moldova stabileşte între persoana fizică şi Republica Moldova o legătură juridico-politică permanentă, care generează drepturi şi obligaţii reciproce între stat şi persoană. Cetăţenia Republicii Moldova se dobîndeşte prin:a) naştere;b) recunoaştere;c) adopție;d) redobândire; e) naturalizare. Cetăţenia Republicii Moldova poate fi dobândită şi în temeiul acordurilor internaţionale la care Republica Moldova este parte.

The purpose of the study. The purpose of the study was aimed at identifying the institution of citizenship with a doctrinal and normative analysis of the legal regime of citizenship of the Republic of Moldova.

In order to achieve the proposed goal, the following objectives were channeled: analysis of the theory of law regarding the institution of citizenship; researching the institution of citizenship in the modern period; examining the doctrinal typification of citizenship in the contemporary period; identification of the legal concept of citizenship; analysis of international regulations regarding nationality and citizenship; examination of European legislation regarding the protection of the institution of citizenship in EU legislation; researching the national legislative regulations regarding citizenship; analysis of the general principles of citizenship of the Republic of Moldova; studying the legal status of the citizen of the Republic of Moldova; discussions on ways to acquire citizenship; case study analysis.

Research methodologyof the research was based on the doctrinal and legislative analysis of the concept and institution of citizenship. From this point of view, a number of norms were analyzed that regulate social relations grouped around the need to ensure the fullness of the rights and obligations provided by the constitution and laws of those persons who, through their feelings and interests, are closely linked to the destinies of the state. Another segment of contemporary debates on citizenship relates to the diversity of its models, the theme being motivated by the existence of distrust in the state's ability to continue to guarantee social justice, the common interest and civic order.

In general terms, we conclude that: The constitutional guarantees of the individual's right to citizenship represent an integrated set of economic, social, political, ideological conditions, enshrined by the Constitution of the Republic of Moldova, which establishes the possibility of enforcement and the mechanisms for its compliance. The national legislation on citizenship is based on the following principles: a) the right of each person to a citizenship; b) non-discrimination of citizens, regardless of the grounds for acquiring citizenship; c) the inadmissibility of arbitrarily depriving a person of his citizenship and the right to change his citizenship; d) avoiding statelessness; e) the non-production of effects, by changing the citizenship of one of the spouses, on the citizenship of the other spouse or on the citizenship of the child if there is no written request to this effect from the parents. The legislation of the Republic of Moldova regarding the institution of citizenship falls within the international requirements regarding citizenship and complies with the principles established by the European Convention on citizenship. Citizenship is analyzed from two perspectives: as a legal condition - the quality of the individual that confirms belonging to a state and conditions the quality of citizen and legal institution constituted by a set of legal norms. The right to citizenship is a fundamental right of the person, which gives value to the other citizenship rights. The citizenship of the Republic of Moldova establishes between the natural person and the Republic of Moldova a permanent juridical-political link, which generates mutual rights and obligations between the state and the person. The citizenship of the Republic of Moldova is acquired by: a) birth; b) recognition; c) adoption; d) reacquisition; e) naturalization.

The citizenship of the Republic of Moldova can also be acquired on the basis of international agreements to which the Republic of Moldova is a party.
