The actuality of theme: The actuality and importance of the addressed theme is demonstrated by the fact that the contemporary society in Sare losuim is built on the basis of the economic model of the free market, based on the relations between the greenhouse and the offer.

Our research justifies its scientific importance by the fact that it is based on an in-depth study, based on the legislation of the Republic of Moldova, the primary and secondary legislation of the European Union, the jurisprudence of the national courts of the Republic Moldova, the jurisprudence of the Court of Justice of the European Union and elements of comparative jurisprudence , by observing the laziness of the national courts in Romania.

The purpose of the study: the study aims to carry out scientific research in order to establish, identify and analyze the general but also the particularities of the abusive relationships in the relationships concluded with the consumers in the pris according to the legislation and jurisprudence of the Republic of Moldova, Romania and the European Union.

The objectives of the study: the analysis and definition of the concept of abusive trade-off and the particularities determined by the nature of the relationships concluded with consumers; the determination and analysis of the conditions established by the legislation and the jurisprudence somparated for a conflicting purpose to be considered abusive; The identification and argumentation of the particularities of the abusive terms used in the context of the contracts concluded with the consumers, presumably the credit contracts.

The novelty and originality of the study: the thesis addresses the highlighting of the features of abusive slander by analyzing the legislation and the practice of the courts of the Republic of Moldova, Romania and the practice of the Court of Justice of the European Union. The novelty of the revision also lies in the identification of legislative imperfections.

Theoretical significance: the content of the study can serve as a theoretical guide for improvement and didactic support within the disciplines: civil law and consumer protection law.

The applicative value: the study gives the possibility of translating the elaborated study into practice, of the orders and the proposals of the law carried out in order to improve the normative framework in the field.
