Delimitarea traficului de ființe umane de infracțiuni adiacente în procesul de calificare

Abstract

Scopul lucrării: constă în examinarea teoretico-practică a infracţiunii de trafic de ființe umane, în vederea rezolvării problemelor şi dificultăților care apar la aplicarea acesteia. Obiectivele cercetării sunt: analiza evoluției cadrului normativ incriminator al infracţiunii; elucidarea conceptului de „trafic de ființe umane”; realizarea unui studiu de drept penal comparat; examinarea semnelor obiective şi subiective aferente infracţiunii cercetate; stabilirea delimitărilor cu alte componențe de infracţiuni asemănătoare.

Obiectivele generale: analiza abordărilor doctrinare a problemei traficului de ființe umane în dreptul penal şi elucidarea naturii juridice a acestei infracțiuni; formularea noţiunii de trafic de ființe umane şi evidențierea caracteristicilor sale de bază; identificarea şi caracterizarea condiţiilor de fond şi de formă ale traficului de ființe umane în contextul legislaţiei naţionale; stabilirea temeiurilor juridice de tragere la răspundere penală a persoanelor care au săvârşit această infracțiune; lucidarea şi caracterizarea elementelor şi semnelor componenței de infracţiune a traficului de ființe umane; identificarea semnelor definitorii ale infracțiunii în delimitarea de alte infracțiuni conexe. Metodele аplicаte lа elаborаreа lucrării: în contextul studiului efectuat au fost utilizate un şir de metode de cercetare, precum ar fi: metoda analizei, metoda comparativă, metoda logică, metoda sistematică și altele.

Rezultatul concret obţinut constă în elaborarea unui cadru conceptual ce va permite interpretarea uniformă a semnelor obiective şi subiective ale infracţiunii incriminate la art.165 CP al RM.

Valoarea aplicativă constă în oferirea unei compilații a materialului doctrinar, formularea recomandărilor practice de soluţionare a unor situații incerte, prezentarea interpretării elocvente a elementelor şi semnelor componenței infracţiunii. Constatările şi concluziile studiului pot fi utilizate în procesul de instruire a studenților instituțiilor de învățământ și în activitatea practicienilor.

The purpose of the thesis: consists in the theoretical-practical examination of the crime of trafficking in human beings, in order to solve the problems and difficulties that arise in its application. The objectives of the research are: analysis of the evolution of the incriminating normative framework of the crime; elucidation of the concept of "trafficking in human beings"; carrying out a comparative criminal law study; examination of the objective and subjective signs related to the investigated crime; establishing boundaries with other components of similar crimes.

General objectives: the analysis of doctrinal approaches to the problem of human trafficking in criminal law and the elucidation of the legal nature of this crime; formulating the notion of human trafficking and highlighting its basic characteristics; identification and characterization of the substantive and formal conditions of human trafficking in the context of national legislation; establishing the legal grounds for bringing to criminal responsibility the persons who committed this crime; clarifying and characterizing the elements and signs of the crime component of human trafficking; identifying the defining signs of the crime in delimitation from other related crimes.

Methods applied for the elaboration of the thesis: in the context of the conducted study, a number of research methods were used, such as: the analysis method, the comparative method, the logical method, the systematic method and others.

The actual result obtained: consists in the development of a conceptual framework that will allow the uniform interpretation of the objective and subjective signs of the crime criminalized in art. 165 of the Criminal Code of the Republic of Moldova. The applicative value consists in offering a compilation of the doctrinal material, formulating practical recommendations for solving uncertain situations, presenting an eloquent interpretation of the elements and signs of the composition of the crime. The findings and conclusions of the study can be used in the training process of students of educational institutions and in the activity of practitioners.
