Mijloacele de apărare ale pârâtului în cadrul acțiunii civile

Abstract

This article deals with the subject of the defendant's defense in the civil action against him. It is wellknown that once the rights and legal interests of the natural or legal person have been violated, the latter may resort to the defense of their rights through both extrajudicial and judicial proceedings. In this respect, the legislator offers the defendant the opportunity to defend himself against the actions taken by the applicant, the defendant not having a passive role in the civil action brought against him. Thus, such means as the reference and the counter-action are discussed, while the structure of these civil procedural acts is also approached.
