Work regulations for people under the age of 18

Abstract

The article deals with the topic of work regulations for people under the age of 18 - a vulnerable category of workers that requires a special protection regime. The International Labor Organization and the European Union have adopted a number of rules - conventions, recommendations, directives, being aimed at protecting young people at work. As a consequence, in order to harmonize internal legislation to the international one, the local legislator has adopted a number of regulations. The subject is being investigating from the theoretical perspective, the legal protection regulations for young people at work in order to discover new ideas and to propose new approaches that will prove to be useful and necessary in practice. At the same time it was highlighted the impact of the theoretical and practical aspects on the evolution of the domestic legal system legislative framework and its relation to the European Union.

Prezentul studiu este dedicat cercetării unei teme foarte actuale şi importante, având în vedere că persoanele în vârstă de până la 18 ani reprezintă o categorie vulnerabilă de lucrători care necesită un regim special de protecţie. Organizaţia Internaţională a Muncii (în continuare – O.I.M.) şi Uniunea Europeană au adoptat o serie de norme - convenţii, recomandări, directive - care vizează protecţia tinerilor la locul de muncă. Drept consecinţă, în scopul armonizării legislației interne la cea internațională, legiuitorul autohton a adoptat o serie de reglementări în acelaşi sens. În prezenta lucrare, s-a urmărit, în special, cercetarea temei din perspectiva teoretică a reglementării protecţiei juridice a tinerilor la locul de muncă, cu obiectivul declarat de a descoperi noi idei şi de a propune noi abordări ce se vor dovedi utile şi necesare în practică. Totodată, s-a urmărit evidenţierea impactului aspectelor teoretice şi practice asupra evoluţiei cadrului legislativ din sistemul juridic autohton în materie, în raport cu evoluţia acestuia la nivelul Uniunii Europene.
