Protecţia juridică a patrimoniului cultural

Abstract

During the last decades of the 20th century, the economic development and globalization, the danger of marginalization and the one of the disappearance numerous communities were facing, as well as the gradual erosion of traditional faiths and convictions determined the reconsideration of the place of cultural heritage at world level, as well as its role in the future of societies. The destruction or decay of national cultural heritage means the disappearance of cultural memory and identity of the Romanian citizens and, consequently, the incapacity of transmitting this inheritance to future generations. At the same time, the building of a sustainable future cannot take place without the inclusion in the development strategies of Romania and subsequent valorization of its most valuable goods – the cultural and natural heritage. The destruction or neglect hereof means at the same time the irreversible impoverishment of the contribution of Romania, as a member of the European Union, to the European cultural diversity. Becoming and raising awareness as for such realities is an important step in the direction of assuring an adequate protection level for one of the most important social values – the national cultural heritage with all its components. Consequently, the investigation of the manner in which national cultural heritage has been legally protected in an interesting topic.
